The website www.mgellogement.fr is the property of MGEL Logement U.E.S., a Cooperative SAS with capital, registered with the Nancy Trade and Companies Register under number 399 903 897, and whose registered office is located at 35 cours Léopold, 54000 Nancy, a subsidiary of the MGEL Group. MGEL, a mutual insurance company subject to the provisions of Book III of the French Mutual Insurance Code, is registered in the SIRENE directory under number 930 749 056 and its registered office is located at 35 cours Léopold 54000 Nancy. Privacy Policy

General Information

The MGEL Group (hereinafter referred to as “MGEL”), whose registered office is located at 35 cours Léopold, 54000 Nancy, and its subsidiaries MGEL Logement, MGEL Logement Hôtelier, including its brands La Pousse Coworking and Moov’ Appart Hôtel, and FAVE, as data controller, attaches particular importance and attention to respecting individual rights, privacy, and data protection, especially personal data.

MGEL processes personal data in compliance with current laws and regulations, notably the “Informatique et Libertés” law of January 6, 1978, as amended by law no. 2018-493 of June 20, 2018, the doctrine issued by the CNIL, and the General Data Protection Regulation no. 2016/679, known as “GDPR,” of April 27, 2016, which came into effect on May 25, 2018.

MGEL undertakes, within the framework of this Data Protection Charter, to implement organizational and technical measures in accordance with current regulations. This Charter demonstrates MGEL’s commitments in its daily activities, particularly concerning the management of its websites.

This document aims to inform our tenants, prospects, students, parents of students, and anyone likely to be affected by data collection by MGEL or one of its subcontractors (processing personal data), about the use, sharing, and/or transfer of data, their rights, the procedures implemented by MGEL, and how we process the personal data we collect or that you provide to us.

Glossary

Personal Data (PD):

Personal Data, hereinafter PD, refers to all information relating to an identified or identifiable natural person (by cross-referencing data).

Concept of processing:

This refers to all operations carried out by automatic or non-automatic means, relating to the collection, recording, development, modification, storage, destruction, editing of data, and generally their exploitation.

Data Controller (here MGEL):

This refers to the natural or legal person who determines the purposes and means of processing.

Processor (processing PD):

This refers to legal entities that process personal data on behalf of a data controller.

Principles applicable to personal data protection

Accountability:

MGEL, as well as all its employees, undertake to respect the fundamental principles of personal data protection and to maintain up-to-date documentation relating to its commitments. In this regard, this Charter is one of the means implemented by MGEL for this accountability objective.

MGEL also requires all its subcontractors to provide appropriate guarantees to ensure the security and confidentiality of personal data.

Lawfulness, fairness, and transparency:

All personal data processing is carried out in strict compliance with regulations, meaning that all personal data processing will be based on an adequate legal basis (including consent, fulfillment of a legal obligation, or MGEL’s legitimate interest, such as commercial development or the security of property or persons).

This data is collected fairly; no collection is made without the knowledge of individuals and without them being informed.

Depending on the services you require, you will be asked to provide mandatory and/or optional information. MGEL undertakes to respect your privacy and protect the information you provide. Any information collected will only be kept for the time necessary to process your requests and/or perform the requested services in accordance with current regulations.

In the event of personal data processing based on the consent of a data subject, MGEL specifies that the said data subject has the discretionary right to withdraw their consent for the purpose(s) presented, in compliance with legal and regulatory provisions.

Adequacy, minimization, and limitation:

The types and quantities of personal data processed are determined adequately, taking into account specific purposes. No data other than what is necessary is processed.

Accuracy and Retention:

Personal data undergoing processing is accurate and, if necessary, kept up to date or modified to maintain its adequacy for the processing it undergoes.

Personal data is retained for a limited period that does not exceed the duration necessary for the collection purposes. Data retention periods are brought to the attention of individuals and vary according to the nature of the data, the purpose of the processing, or legal or regulatory requirements. In the absence of a precise duration, MGEL presents the criteria used to determine this duration.

For example, any data used in the context of a contact request cannot be retained for more than 3 years from the last contact. In any case, and subject to contrary regulatory provisions, no retention period may exceed 5 years, in application of legal prescription periods.

Data collection and processing

Data you transmit to us:

When you interact with MGEL, in any way whatsoever, you may transmit information to us, including personal data (PD). This is particularly the case when you fill out a pre-reservation form, complete a contact sheet, or send us an email to inform us of a situation concerning you, for example, via the address contact@mgellogement.fr.

More specifically, this includes:

  • Data related to the creation of your “Tenant Area.” This data includes your last name, first name, email address, mobile phone number, password;
  • Data necessary for renting accommodation we offer you. This data mainly includes your last name, maiden name (if applicable), first name, email address, postal address, parental home address, date of birth, place of birth, landline and/or mobile phone numbers, banking information, copy of identity document;
  • Data necessary for subscribing to an offer/service we provide. This data mainly includes your last name, maiden name (if applicable), first name, email address, postal address, parental home address, date of birth, place of birth, landline and/or mobile phone numbers, identifier, password, social security number (NIR), identity photograph, receipts, invoices, prescriptions, bank account details (RIB), parents’ socio-professional categories, resources, and any other data allowing us to “get to know you better”;
  • Data related to your current contracts or quote request(s). This data mainly includes proof of address, photocopy of identity card, passport, and/or residence permit, driver’s license, sworn statements, etc.;
  • Data related to participation in contests, surveys, and satisfaction questionnaires. This data mainly includes a copy of all exchanges and responses between you and MGEL. This information may be collected, gathered, and used for analyses and research related to the purposes set out on the various media at the time of participation;
  • Data we may request from you in response to contact requests, in case of problem(s) or complaint(s); particularly in exchanges and responses between you and MGEL. This data mainly includes your last name and first name, email address, apartment number if applicable, phone number, and any other data allowing us to process your request;
  • Data collected in the exercise of your rights; notably a copy of your identity document;
  • And other information you wish to communicate to us, such as a particular personal situation, your lifestyle habits, health-related data.

Automatically collected data

MGEL, as data controller, and its subcontractors may, in certain cases, automatically collect data. This is particularly the case when you log in to your Account on the www.mgellogement.fr website or one of our applications, but also during your visits to our agencies. During these visits, MGEL may collect, with your consent or within the framework of the execution of your contracts, information relating to your requests, devices used to access our services, connection IP addresses, browsing data, downloads, entered information, etc. For the needs of MGEL and its subcontractors, particularly for statistical purposes, MGEL uses cookies whose permissions you can modify on our platforms.

The following information may also be collected: passwords and identifiers, refunds received, types and numbers of current and expired contracts, searches, FAQs, pages viewed, questions, quote requests, etc.

Purposes:

Personal data is collected for specific purposes (main purposes), brought to the attention of the data subjects. This data cannot be used later in a manner incompatible with these purposes.

Within the framework of this website www.mgellogement.fr, the main purposes for which any personal data is processed are:

  • Information request and contact;
  • Pre-reservation request for accommodation and file creation;
  • Housing Allocation Committee (CAL) review with file evaluation;
  • Login to the tenant area;
  • Management of your tenant lease’s lifecycle;
  • If you have consented, commercial prospecting.

Data Confidentiality / Security:

Protection measures, both technical and organizational, are implemented, adapted to the nature of the data processed and the company’s activities, to guarantee data confidentiality and security, particularly to prevent unauthorized access.

MGEL requires, and verifies that any subcontractor (within the meaning of regulations inherent to personal data protection) provides appropriate guarantees to ensure the security and confidentiality of personal data, particularly in the context of collaboration in the event of a security incident. Also, any request for the exercise of rights will be communicated to any concerned subcontractor. MGEL cannot be held responsible for their processing times.

Cookie Policy and Social Networks:

MGEL may process information through cookies placed on your device. This information may include the domain name, internet service provider, date and time of use, browsing (pages viewed, searches performed, etc.), location, or the operating system used by the user.

Cookies are used solely for data analysis (statistics). This information is used to improve our materials and content and to correct malfunctions encountered, particularly depending on the operating system used.

You can refuse the use of cookies, however, this may limit your browsing on our sites.

On some of our platforms, you have the option to share content on social networks such as Facebook, Twitter, LinkedIn, etc. Social networks allow the site to be enriched, particularly through sharing or information feeds. Rights of data subjects:

MGEL undertakes to respect, for natural persons concerned by personal data processing implemented by it, the rights granted to these persons, in accordance with current regulations, namely:

A right of access and information

MGEL takes all appropriate measures to provide clear, concise, and transparent information to data subjects regarding the processing of their personal data;

A right to rectification

MGEL ensures, as far as possible and taking into account the purposes of the processing, that all personal data is accurate, and, in case of inaccuracy, undertakes, upon request, to modify any inaccuracy relating to personal data within legal deadlines;

A right to erasure (right to be forgotten)

MGEL undertakes, upon simple request from the data subject, to erase any personal data concerning them in compliance with legal and regulatory provisions;

A right to restriction of processing

MGEL undertakes to respect any request for restriction in the processing of a data subject’s personal data;

A right to data portability

MGEL undertakes to ensure the portability of a data subject’s personal data to another data controller;

A right to object

MGEL also undertakes to respect the right of a natural person to object to the processing of personal data concerning them;

A right to decide the fate of personal data after death

MGEL undertakes to respect the directives given by a data subject concerning their personal data after their death, taking into account applicable legislation;

A right not to be subject to automated individual decision-making

MGEL undertakes not to implement personal data processing in such a way that a data subject is subject to an automated individual decision, including profiling, without first obtaining their consent or providing them with appropriate information.

Exercise of rights

In accordance with current regulations, MGEL undertakes to provide a response to any request or exercise of rights from a natural person concerned by personal data processing implemented by MGEL, within the legal conditions and deadlines, following a request made in writing or by email, accompanied by a signed copy of an identity card in the name of the applicant (solely for identification and fraud prevention purposes) possible at the following addresses:

Recourse to a competent supervisory authority

In accordance with regulations, any person concerned by personal data processing has the right to lodge a complaint with a competent supervisory authority under current regulations.

Evolution of the Data Protection Charter

MGEL undertakes to update this Policy regularly to take into account legislative and regulatory developments, or any changes in its organization or proposed services.

The applicable Charter is the one in force on the day of connection to this site. MGEL reserves the right to modify, at any time and without notice, this Charter, particularly for updating purposes.

Consumer dispute mediation mechanism

In accordance with articles L611-1 et seq. and R612-1 et seq. of the Consumer Code, it is stipulated that for any contractual dispute concerning the performance of the sales contract and/or the provision of services that could not be resolved through a complaint previously submitted to our customer service, the Consumer may have recourse to mediation free of charge.
